What is the U.S. E-2 Treaty Investor visa?

The E-2 Treaty visa is for individuals who wish to obtain residence in the USA to develop and direct business operations that they invest in.

The E-2 visa can be attainable to owners and prospective owners of businesses in the United States as well as their employees.

This visa is very popular because of the reduced investment compared with other investor visas. It can also be renewed or extended as required making it a viable long-term visa that can be used as part of further immigration planning to obtain permanent residency.

What are the requirements?

One of the key criteria that distinguishes the E-2 Treaty visa is the requirement for the investor applicant to hold nationality of a Treaty country. The list of Treaty countries details the nationalities which are eligible to apply. If your nationality is not on this list we can offer alternative routes — which can include the further benefit of a second passport — however the total cost will be higher.

Although there is no official figure for the "substantial investment" requirement, there is a common rule: the lower the cost of the business, the higher the percentage that is required to constitute a substantial investment. Conversely, the higher the cost of the business, the lower the percentage required.

We believe in being fully transparent and based on our significant experience we suggest that applicants should have access to at least $120,000 in order to demonstrate the ability to fund their business, cover all fees, support themselves, and therefore be successful when applying.

Investors must also own at least 50% of the business and be in a position to direct its active development.
